I have a two year old daughter with my past gf. She has constantly looked for things to hold against me. She has made several acqusations against me and my wife. First time right after I got married. She filed a EOP against my wife because my 1yr old daughter called my wife mom-mom. I have vacation this week with my daughter but she is already saying she is keeping her from me cause she heard my wife and I had an arguement(over car keys). I've heard after so many times of her filing or withholding my daughter I might be able to get full custody. Is this true? What steps should I take?

'Tis a really tough situation. But the only thing I can say is get a lawyer. And not just any lawyer, find one that has experience with family law and situations. And document EVERYTHING. Factually, not emotionally. Start a notebook and calendar. You'll need it.

I have witnessed a real 'mother' of a so called "mother" using her kids as pawns in a divorce. Your situation will be different of course, and laws are different from state to state. Sole custody based just on what you've presented here, I don't see happening. (Though I'm sure there's more to your story. Not asking, no need to air any dirty laundry here.) Courts are very reluctant to ever do that anyway. They see BOTH parents as important (and they are), even when the situation seems clear that one is certainly NOT benefiting the child at all.

But also remember, you WILL have to deal with this woman forever. It's very hard and you will have to rise above and suck it up, all too often. But that's the only way to prevail, in the court system, but more importantly in the life of your daughter.

I've got a lawyer and been to court before where she kept her from me. Just don't want to loose every vacation with my daughter. I lost mine last yr cause of this. Judge just seems to want us to drop all disputes and get along. Which would be great but she wants me out of my daughters life.

Hang in there. You will regret it later if you give up and let your daughter go. I really admire you for your willingness to go through the work required to have time with your daughter.
