I need advise. I am a father in process of divorce. I moved out of the state for work and she moved away from the city where we used to live. When she let me know that she wanted the divorce our son was 4 months old. He was born in August 2011.

I saw my son last time in August 2012 when I moved. We have been working slowly on a parenting plan. It has been a long road. She does not want my son to spend time with me. We have not been able to agree that he is going to spend 60 days with me every year.

But among those days we agreed, there is a week off I have in April. She had previously agreed on my son spending this time with me. Now she is denying me this. She argues that it would be hard for my son to be far away from her because of his age (1 year 8 months by April).

It is very expensive for me to go and visit him. I am far and I would have to pay a hotel in the place where she moved. I think it is my right to have my son with me for at least short periods of time. Any advise is welcomed.

Just for the record, while married she cheated on me, she asked for the divorce, she kicked me out of the house, she has demanded and got a lot of money on child support, she has been aggressive toward me, and now she claims she is worried about the emotional well being of the child. She is always willing to show me the child on skype but when we actually agree something happens so she cannot make it.

Tough situation. I can only say to DOCUMENT, DOCUMENT, DOCUMENT. And I mean EVERYTHING. You need to find an experienced family law attorney. Preferably one who works well and is successful for fathers.

And do your best to be 100% there for your kid as much as possible. Focus on the child. Not the bad relationship with your ex.

I agree with you here. One of my good friends has been in a situation like this before, and things actually turned out really nasty. Law suits, Lawyers, in-laws, and all those other scary words that contain "law" in them were of plenty. It was hard to focus on doing anything for their kid because there was so much fighting. Divorce is an understatement for loneliness.
